                              Hon'ble Ashish Naithani, J.

Mr. Karan Singh Dugtal, learned counsel for the Revisionist.

2. Mr. G.C. Joshi, learned A.G.A. for the State of Uttarakhand.

3. The present Criminal Revision has been filed against the judgment and order dated 26.08.2025, passed by the Court of the learned Additional Sessions Judge, Khatima, in Criminal Appeal No. 24 of 2024, "Mohammad. Aarish Ansari vs. State of Uttarakhand", whereby the learned Appellate Court has rejected the appeal preferred by the Revisionist and maintained the sentence awarded to him by the judgment and sentencing order dated 12.06.2024, passed by the Court of the learned Additional Chief Judicial Magistrate, Khatima, in Criminal Case No. 727 of 2022, by which the Revisionist was convicted for the offence punishable under Section 3/25 of the Arms Act, 1959, and sentenced to undergo rigorous imprisonment for a period of two years, along with a fine of Rs. 2,000/-, and in default thereof, to further undergo one month's additional imprisonment.

4. Admit.

5. List this case on 28.11.2025.

6. Heard on the Suspension of Sentence (IA No. 01 of 2025).

7. It is submitted by the learned counsel for the Revisionist that the Revisionist was on bail during the trial as well as during the pendency of the appeal, and that he did not misuse the liberty granted to him.

8. The learned State Counsel opposed the bail application; however, he fairly conceded that the Revisionist remained on bail during the trial as well as during the pendency of the appeal.

9. This Court is of the considered opinion that, having regard to the facts and circumstances of the case, the Revisionist deserves to be enlarged on bail during the pendency of the present Revision.

10. Accordingly, the Revisionist, Mohammad Aarish Ansari, shall be released on bail upon executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the Trial Court.

11. It is clarified that the grant of bail shall not be treated as a ground for seeking adjournments or for delaying the disposal of the present Revision.

(Ashish Naithani, J.) 17.10.2025 Shiksha
