Mr. Amit Kapri, learned counsel for the appellant/Insurance Company.

2. Mr. Rakshit Srivastava, learned counsel for respondent nos.3 & 4/claimants.

3. Misc. Application (IA No. 14783 of 2025), enclosing the bank details of the claimants, is allowed. The bank details of the claimants are taken on record.

4. This appeal is directed against the judgment and award dated 27.07.2019 passed by M.A.C.T./1st Additional District Judge Nainital in M.A.C.P. No. 180 of 2014, whereby the compensation of ₹7,93,118/- has been awarded in favour of the claimants.

5. Heard on Money Withdrawal Application (IA 14781 of 2025)

It is stated in the application that, by order dated 01.11.2019, this Court stayed the execution of the impugned award subject to the deposit of the entire awarded amount by the appellant/ Insurance Company before the learned Tribunal. In compliance thereof, the appellant/ Insurance Company has deposited the said amount before the Tribunal.

7. The applicants/respondent nos. 3 & 4/claimants have moved the present application seeking release of the deposited amount, stating that they are in pressing need of funds to meet household expenses, medical treatment, and livelihood requirements.

8. For the reasons stated, the Money Withdrawal Application is allowed.

9. It is directed that out of the total amount deposited by the appellant/Insurance Company before the learned Tribunal, 50% of the said amount shall be released in favour of respondent nos. 1 and 2/claimants, and the remaining 50% shall be kept in an interest-bearing fixed deposit in a nationalised bank, subject to further orders of this Court.

10. List this appeal in due course.

11. Urgency application (IA 14782 of 2025) stands disposed of accordingly.
