2. Mr. Karan Anand, learned counsel for the Respondent.

3. The present Criminal Revision has been preferred against the impugned judgment and order dated 01.05.2023, passed by the learned Judge, Family Court, Vikasnagar, District Dehradun, in Misc. Criminal Case No. 99 of 2022, "Smt. Madhu Chhetri vs. Shri Narendra Singh Chhetri", under Section 125 of the Code of Criminal Procedure, 1973.

4. Learned counsel for the Revisionist submits that the impugned order is wholly unjust and unsustainable in the eyes of law.

5. Admit.

6. Objections/Counter Affidavit, if any, be filed by the Respondent.

7. List this case on 15.12.2025.

8. The Revisionist has also filed a Stay Application (I.A. No. 02 of 2025), praying that the effect and operation of the impugned ex parte judgment and order dated 01.05.2023, passed by the learned Judge, Family Court, Vikasnagar, District Dehradun, in Misc. Criminal Case No. 99 of 2022, "Smt. Madhu Chhetri vs. Shri Narendra Singh Chhetri", under Section 125 Cr.P.C., be stayed during the pendency of the present Revision.

Considering the facts and circumstances of the case, as an interim measure, it is directed that till the next date of listing, the effect and operation of the impugned ex parte judgment and order dated 01.05.2023, passed by the learned Judge, Family Court, Vikasnagar, District Dehradun, in Misc. Criminal Case No. 99 of 2022, shall remain stayed, subject to the condition that the Revisionist shall pay 50% of the awarded amount per month as interim maintenance to the Respondent.

10. It is further directed that the arrears of maintenance shall be paid in such manner and on such terms as may be mutually agreed upon between the parties, within a period of two months.

11. The Stay Application (I.A. No. 02 of 2025) stands disposed of accordingly.
