3. Arguments heard at length.

4. At page no. 60 of the appeal there is "uD'kk utjh" (site plan) and certain photographs have been placed. The suit is filed for the common passage which was decreed, however, the First Appellate Court set-aside the judgment and decree. The sale deeds of both the plaintiff and the defendant are on record and on perusal of both the sale deeds it reveals that there is common passage of 10ft. wide.
