2. Mr. Deepak Bisht, learned D.A.G. for the State.
3. Revisionist is the Managing Director of R Zone Developers Private Limited. Respondent no. 2 filed a complaint under Section 138 alleging that the revisionist have issued cheques of Rs. 5 Lakhs, which was dishonoured. The learned Magistrate, after considering all relevant aspect, imposed a fine of Rs. 40,000/- alongwith six months imprisonment to Mr. Ravindra Kumar, Managing Director of R Zone Developers Private Limited.
4. This order was challenged by him in appeal before the Sessions Judge in which the order of the Magistrate was upheld. Against both these orders, the present revision has been preferred.
5. Learned counsel for the revisionist would submit that he is ready and willing to pay Rs. 4.5 Lakhs of which he has prepared the demand draft also. He has further submitted that the Company have deposited Rs. 1,08,000/- before the Appellate Court and the said amount was withdrawn by the complainant.

11. It is made clear that the revisionist shall produce the demand draft on the next date of hearing.
Heard on Bail and Suspension of Sentence Application.
12. The instant revision is preferred against the judgment and order dated 21.06.2022 in Criminal Appeal No. 162 of 2019 R Zone Developers Pvt. Ltd. Vs. State of Uttarakhand and Another, whereby, the learned 2nd Additional Sessions Judge, Dehradun, has dismissed the appeal filed by the revisionist/accused herein, as well as the judgment dated 01.06.2019 passed in Complaint Case No. 4161 of 2015, Vishnu Dutt Bakshi Vs. R Zone Developers Pvt. Ltd. by the learned 2nd Judicial Magistrate, Dehradun whereby the complaint filed by the respondent/complainant was allowed and the revisionist was sentenced to undergo simple imprisonment of six months and a fine of Rs. 5,40,000/-.

Having heard learned counsel for both the parties, the suspension of sentence application (IA No. 1 of 2022) is allowed and it is directed that execution of sentence awarded to the accused/appellant shall remain suspended during and until the conclusion of the revision, subject to the revisionist executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
14. Exemption Application (IA No. 3 of 2025) stands disposed of accordingly.
