Mr. Vikas Anand, learned counsel with Mrs. Gyan Mati Kushwaha, learned counsel for the Revisionist.

2. Mr. S.S. Chauhan, learned Deputy Advocate General with Mr. Bhaskar Chandra Joshi, learned AGA assisted by Mr. Vikas Uniyal, learned Brief Holder for the State.

3. Present criminal revision is being preferred by the revisionist for setting aside the impugned judgment and order dated 17.07.2019 passed by learned Additional Chief Judicial Magistrate/Civil Judge (S.D.), Kashipur, District Udham Singh Nagar in Criminal Case No.1858 of 2012 State of Uttarakhand vs. Kumar Gaurav @ Vishal Giri and Another for the offence punishable under Section 420 and 506 of IPC on the basis of FIR No.68 of 2012 registered at P.S. Jaspur, District Udham Singh Nagar whereby the revisionist had been acquitted for the offence under Section 506 of IPC and had been convicted and sentenced under Section 420 of IPC for a period of five years rigorous imprisonment. Further prayer has been made to set aside the judgment and order dated 30.08.2024 passed by learned Third Additional District and Sessions Judge, Rudrapur, Udham Singh Nagar in Criminal Appeal No.209 of 2019.

4. The matter is listed for disposal of bail application.

5. Learned counsel for the revisionist submits that revisionist is in judicial custody since 11 months. He submits that revisionist was on bail during the pendency of trial and appeal and he had never misused the same.

6. List this revision on 10.12.2025.

7. Heard on bail application.

8. Without going into the merits of the case and considering the fact that the revisionist was on bail during trial and appeal, this court finds it sufficient to enlarge the revisionist on bail. Let the revisionist- Kumar Gaurav @ Vishal Giri be released on bail on his furnishing a personal bond and two sureties of the like amount to the satisfaction of the court concerned during the pendency of this revision.
