Mr. Neeraj Garg, learned counsel for the Petitioner.

2. Mr. Nikhil Singhal, learned counsel for the Caveator.

This writ petition has been filed by the Petitioner under Article 227 of the Constitution of India challenging the judgment and order dated 09.09.2025 passed by the court of learned 1st Additional District Judge, Haridwar in Rent Control Appeal No.18 of 2024, "Krishna Kumar Sharma Vs. Dr. Narayan Dutt Mishra and another", as well as the judgment and order dated 17.02.2024 passed by learned Prescribed Authority in PA Case No.4 of 2021, "Narayan Dutt Mishra and another Vs. Krishan Kumar Sharma", whereby the release application under Section 21 (1) (a) of the UP Act No.13 of 1972 being PA Case No.5 of 2023, filed by the Respondent has been allowed by learned Prescribed Authority releasing the property in question in favour of the Respondent, and statutory appeal under Section 22 of UP Act No.13 of 1972, preferred there against by Petitioner has also been dismissed.

5. Counter affidavit to be filed within a period of three weeks.

6. Till the next date of listing, the effect and operation of the impugned judgment and order dated 09.09.2025 passed by the court of learned 1st Additional District Judge, Haridwar in Rent Control Appeal No.18 of 2024, "Krishna Kumar Sharma Vs. Dr. Narayan Dutt Mishra and another", as well as the judgment and order dated 17.02.2024 passed by learned Prescribed Authority in PA Case No.4 of 2021, "Narayan Dutt Mishra and another Vs. Krishan Kumar Sharma" shall remain stayed, subject to the condition that the matter may not be lingered on.

7. List this matter on 13.11.2025.

8. Stay application (IA No.1/2025) stands disposed of accordingly.
