Mr. Dinesh Chandra Dimri, learned counsel for the Revisionist through video conferencing.

2. Mr. Rakesh Negi, learned Brief Holder for the State of Uttarakhand.

The present Criminal Revision is being filed against the judgment and order dated 08.10.2024, passed by learned Additional Chief Judicial Magistrate, Tehri Garhwal in Criminal Case No. 346 of 2023, "Sanjay Kumar Bisht vs. Arvind Mohan Uniyal" for the offence punishable under Section 138 of Negotiable Instruments Act, 1881 as well as judgment and order dated 18.09.2025, passed by learned Additional Sessions Judge, Tehri Garhwal in Criminal Appeal No. 73 of 2024, "Arvind Mohan Uniyal vs. State of Uttarakhand and Another".

5. Issue notice to Respondent No. 2.

6. Steps to be taken within a week.

7. List this case on 25.11.2025.

8. Heard on the Bail Application (IA No. 1 of 2025).

9. It is submitted by learned counsel for the Revisionist that the Revisionist was on bail during the trial as well as during the pendency of the appeal, and he did not misuse the liberty granted to him.

10. Learned State Counsel opposed the bail application. However, he conceded that the Revisionist remained on bail during the trial as well as during the pendency of the appeal.

11. This Court is of the considered opinion that, considering the facts and circumstances of the case, the Revisionist may be enlarged on bail during the pendency of the present Revision.

12. Accordingly, the Revisionist- Arvind Mohan Uniyal shall be released on bail upon executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the Trial Court.

13. It is clarified that the grant of bail shall not be treated as a ground for seeking adjournments or for delaying the disposal of the present Revision.
