Hon'ble Ravindra Maithani, J. (Oral) The challenge in this appeal is made to order the order dated 08.08.2024 passed in Misc. Case No. 139 of 2021, connected with Original Case No. 963 of 2015, Smt. Renu Rawat vs. Manwar Singh Rawat ("the case"), whereby the learned Judge, Family Court, has allowed the respondent's application under Order IX Rule 13 C.P.C. and set aside the ex parte judgment dated 15.03.2016 passed in the case.

2. Today, during the course of hearing, learned counsel for the appellant would submit that the case itself has already been dismissed for non-prosecution on 07.10.2024. A copy of the said order dated 07.10.2024 has been tendered before this Court, which is taken on record. Hence, the present appeal has been rendered infructuous.

3. In view of the above, the appeal stands disposed of as having been rendered infructuous.
