Mr. Pankaj Kumar, learned counsel holding brief of Mr. Neeraj Garg, learned counsel for the Revisionist.

2. Mr. N.S. Kanyal, learned AGA, for the State of Uttarakhand.

3. As per the past order-sheet, there is a representation on behalf of the Respondent No.2 through the learned counsel Ms. Sukhwani Singh, but nobody's appears today on behalf of the Respondent No.2. Since there is no representation on behalf of the Respondent No.2, in the interest of justice, an opportunity is accorded for filing objections, if any.

4. The present criminal revision is directed against the judgment and order dated 17.01.2024, passed by the court of learned Principal Judge, Family Court, District Dehradun, in Criminal Case No.257 of 2021, "Smt. Divya Agarwal Vs. Sumit Agarwal", whereby directing the Revisionist to pay an amount of Rs.23,000/- per month as interim maintenance to the Respondent No.2 and their minor son and daughter.

5. Counter affidavit to be filed within a period of three weeks.

6. Considering the overall facts and circumstances of the case, an interference is being called for in the matter.

7. Till the next date of listing, the effect and operation of the impugned judgment and order dated 17.01.2024, passed by the court of learned Principal Judge, Family Court, District Dehradun, in Criminal Case No.257 of 2021, "Smt. Divya Agarwal Vs. Sumit Agarwal", shall remain stayed, subject to the condition that the Revisionist shall pay an amount of Rs.11,500/- per month as interim maintenance to the Respondent No.2 and their minor son and daughter.

8. List this matter for final hearing on 24.11.2025.
