(2) Since common questions of fact and law are involved in these petitions, therefore, these petitions are clubbed together and decided by this common judgment. However, for the sake of brevity and convenience, facts of WPSS No. 1963 of 2025 alone are being considered and discussed.
(3) Petitioners are serving as Lecturer in different Government Intermediate Colleges in Garhwal Region.
(4) According to the petitioner, he is entitled to benefit of Rule 13(i) & (ii) of Uttarakhand Government Servant Salary Rules, 2016, however, the said benefit has been denied to him. In this writ petition, petitioner has sought the following relief:-
"(i) Issue any suitable writ, order or direction in the nature of mandamus commanding and directing the respondent to decide/dispose the representation (Annexure no. 5) of the petitioner by a reasoned and speaking order within a stipulated time considering Rule 13(i) (ii) of the Salary Rules, 2016 as well as in light of order dated 13.03.2024 passed by this Hon'ble Court in writ petition no. 391 of 2024 (S/S) Chandra Singh Chiral vs. State of Uttarakhand and Ors contained as Annexure no. 3 to this writ petition. "

(5) Learned State Counsel submits that petitioner has sought a writ of mandamus and he has also made a representation, but that representation is a joint one, along with several other lecturers. He submits that if petitioner makes separate fresh representation to the competent authority, the competent authority shall examine the claim of the petitioner and pass necessary orders, as per law.
(6) The writ petitions are, accordingly, disposed of with liberty to petitioners to make separate fresh representations claiming benefit of Rule 13(i) & (ii) of Uttarakhand Government Servant Salary Rules, 2016 to Director, Secondary Education. If petitioners make separate representations within two weeks from today, Director Secondary Education shall examine petitioners' claim and pass necessary orders, as per law, within seven months from the date of presentation of certified copy of this order.
