Mr. Shariq Khurshid, learned counsel for the Revisionist.

2. The present criminal revision under Section 438/432 of BNSS, 2023 is moved on behalf of the Revisionist to set-aside the impugned judgment and order dated 17.04.2025 passed by learned Additional Principal Judge, Family Court, Kashipur, District Udham Singh Nagar in Misc. Criminal Case No.126/2023, titled as "Smt. Kavita Rani & Anr. Vs. Vishal" under Section 125 of Cr.P.C.

Heard on the Delay Condonation Application (IA No.01/2025)

3. There is delay of 41days in filing the present revision.

4. Not objected to by the learned State counsel.

5. Delay Condonation Application is filed along with the affidavit of the Revisionist.

6. For the reasons stated, the Delay Condonation Application is allowed. Delay is hereby condoned.

7. Heard.

8. Admit.

9. Issue notices to the Respondents, returnable within two weeks. Steps to be taken within one week.

10. Objections, if any, to be filed by the Respondents within three weeks.

11. List this matter on 30.12.2025.

12. Till the next date of listing, the effect and operation of the impugned judgment and order dated 17.04.2025 passed by learned Additional Principal Judge, Family Court, Kashipur, District Udham Singh Nagar in Misc. Criminal Case No.126/2023, titled as "Smt. Kavita Rani & Anr. vs. Vishal" under Section 125 of Cr.P.C., shall remain stayed to the extent that the Revisionist/husband shall pay 25% of the arrears to the Respondent/wife. In default of the same, the stay shall stand vacated automatically.

13. Stay Application (IA No.02 of 2025) stands disposed of.
