2. Mr. S.C. Dumka, learned A.G.A. with Ms. Sweta Badola Dobhal, learned Brief Holder for the State of Uttarakhand/ respondent No.1.

3. Counter affidavit filed by the State is taken on record. Miscellaneous application (IA/1/2023) made therefor, is allowed.

4. Learned State Counsel passed on to this Court instruction dated 01.10.2024, which is taken on record. Learned State Counsel submits on the basis of the said instruction that after trial, the applicant- Sohan Singh has been acquitted of the charges by the learned Additional District Judge/F.T.S.C., Haridwar, vide judgment and order dated 20.07.2024 in Sessions Trial No.155 of 2021 State Vs. Sohan, therefore, nothing remains to be decided in the present matter and it has become infructuous.

5. In view of the statement made by learned State Counsel, the present C482 application is dismissed as infructuous.
