Mr. N.K. Papnoi, Standing Counsel for the State/respondent nos.1 to 4. It is the case of the petitioner that the matter is squarely covered by the judgment dated 07.04.2025, passed in WPSS No.2014 of 2023, Ajit Singh Vs. State of Uttarakhand and others, because recovery has been made from the retiral dues of the petitioner, which is not permissible in view of the law as laid down by the Hon'ble Supreme Court in the case of State of Punjab and others Vs. Rafiq Masih, (2015)4 SCC 334.
Learned State Counsel, under instructions, would submit that the matter is not covered.

Learned Chief Standing Counsel takes notices on behalf of respondent nos.1 to 4.
Counter affidavit shall be filed within two week positively. A week thereafter, rejoinder affidavit, if any, shall be filed. It is a matter pertaining to recovery of retiral dues from an employee. It gains importance.
List for final hearing on 30.06.2025 No extension of time shall be granted for completing pleadings.
