Present proposed First Appeal has been filed challenging the judgment and decree dated 16.01.2025, passed by the learned IVth Additional Civil Judge, Senior Division, Dehradun in Original Suit No.426 of 2019, by which, the said suit, filed for cancellation of the Gift Deeds dated 26.01.2010 and 02.02.2010 and for perpetual injunction, has been dismissed.

2. Present proposed First Appeal has been filed along with an Application under Section 5 of the Limitation Act, 1963 to condone the delay of 89 days.

3. Heard Mr. V.K. Kohli, learned Senior Advocate assisted by Mr. Kanti Ram Sharma, learned counsel for the proposed appellants.

4. Notice is being issued to the respondents on the Delay Condonation Application (IA No.1 of 2025). Steps to be taken within a week.
