Upon hearing the learned Counsel, the Court
made the following


JUDGMENT :

Mr. Hitesh Chandra Semwal, learned Brief

Holder for Mr. Sagar Kothari, learned counsel for the

applicant, submits that the instant Application has been

rendered infructuous in view of the fact that both the

parties, by consent, have appointed Sri Kurian Joseph,

Judge Supreme Court of India (retired), and the

dispute resolution has been entrusted to Hon'ble Mr.

Justice Kurian Joseph, former Judge, Supreme Court of

India.

2. In that view, the appointment of the

Arbitrator having been completed outside, by consent

2025:UHC:6008 of parties, the instant Application does not survive for

consideration and the same is, accordingly, rejected.

10. There shall be no order as to costs.

11. In sequel thereto, all pending Applications

stand disposed of.
