An Application, under Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 was filed by the applicant. The said Application was dismissed. A Criminal Revision (No.66 of 2025) was filed. The said Criminal Revision has been dismissed vide judgment dated 25.11.2025, passed by learned Ist Additional District and Sessions Judge, Haldwani, District Nainital.

2. Heard Mr. Zafar Siddique, learned counsel (through video conferencing) for applicant and Mrs. Sweta Badola Dobhal, learned Brief Holder for respondent.

3. Mr. Zafar Siddique, Advocate, on instruction, has requested to permit the applicant-Chandra Sagar to withdraw the present Application, filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 with a liberty to file afresh with better particulars.

4. The present Application (No.2299 of 2025), filed under Section 528 of the 2025:UHC:11630

Bharatiya Nagarik Suraksha Sanhita, 2023, is dismissed as withdrawn granting liberty to the applicant to file afresh, but in accordance with the law.
