2. Mr. C.S. Rawat, Chief Standing Counsel and Mr. B.S. Parihar, Additional Chief Standing Counsel for the State of Uttarakhand/respondents.

3. Petitioner's request for permission to advertise the vacancies, has been turned down by holding that the vacant posts are no more in existence, in view of provision contained in Regulation 21 Chapter-II of the Regulations framed under Uttarakhand School Education Act.

4. Learned counsel for the petitioner submits that the stand taken by the Chief Education Officer and Secretary is contrary to the judgment rendered by this Court in WPMS No. 2839 of 2023.

5. Learned Chief Standing Counsel, however, submits that if petitioner submits application for revival of the posts as per Regulation 21 Chapter-II of the Regulations, decision on the proposal shall be taken by the competent authority, as per law, within six weeks.

6. List on 26.02.2026.

7. Counter affidavit be filed by the respondents in the meantime.

8. In the meantime, petitioner shall be free to apply for revival of posts, by making application before the competent authority.
