The respondent no.5 joined the proceedings through video conferencing.
It appears that the respondent no.5 has disobeyed the judgment passed by this Court on 17.03.2017, passed in WPSS No.998 of 2015, Bhupal Singh Sahi and Others Vs. State and others, of which non- compliance is reported. But, what is being told by the respondent by the respondent no.5 is that there is no vacant post available, against which the orders have been passed to regularize the petitioners. It is also argued that, in fact, since 2018, the petitioners are not working, despite having been given multiple reminders.
It is submitted by learned State Counsel that against the judgment dated 17.03.2017, a special appeal was filed, in which a stay order was passed. He seeks permission to file all those documents on record.
A question arose as to whether the petitioners refused to attend the duties, despite being called by the respondent no.5 in its department?
Learned counsel for the petitioners submits that the petitioners were denied to work. He seeks time to file those documents.
Let the petitioners file their documents within a week.
A week, thereafter, respondent no.5 may file its response, and, may also file any additional document, if so desires.
On 19.02.2026, this Court would consider this matter as to whether this non- compliance is wilful disobedience or not.
