Instant appeal is preferred against the judgment and

order dated 11.11.2025, passed in Special Sessions Trial No.39 of

2021, State of Uttarakhand Vs. Mahesh Bhatt and others, by the

court of Special Sessions Judge (N.D.P.S.) Pithoragarh. By it, the

appellant has been convicted and sentenced under Sections

20(b)(ii)(b) of the Narcotic Drugs and Psychotropic Substances Act,

1985. The appellants Mahesh Bhatt and Kailash Bhatt seek bail

during pendency of the appeal.

2. Heard.

3. Admit.

4. Call for the LCR.

5. Heard on Bail Application (IA) No.01 of 2025.

6. Learned counsel for the appellants would submit that

the appellants were in jail during trial; they have never misused the

bail.

7. These facts are admitted by learned State Counsel.

8. Having considered, this Court is of the view that it is a

case in which the execution of sentence should be suspended and

the applicants/appellants be enlarged on bail.

9. The bail application is allowed.

10. The execution of sentence, which is under challenge in

this appeal shall remain suspended during the pendency of the

appeal.

11. Let the applicants/appellants be released on bail,

during pendency of the appeal on their executing a personal bond

and furnishing two reliable sureties, each of the like amount, by

each one of them, to the satisfaction of the court concerned.

12. List in due course.
