2. Mr. Veer Kunwar Singh, learned counsel for respondent through Video Conferencing.
3. This first appeal has been filed by the appellant against the judgment and order dated 29.10.2022 passed by the learned Senior Civil Judge, Bageshwar in O.S. No. 23 of 2021, under Section 13(1)(ia)(ib) of the Hindu Marriage Act.
4. There is a delay of 39 days in filing the present first appeal. Accordingly, the appellant has filed Delay Condonation Application (IA No. 1 of 2023) seeking condonation of the said delay.
5. The respondent despite opportunity has been given, have not filed objections.
6. Having considered the grounds taken in the application, we are of the view that the sufficient cause has been shown for condoning the delay. Accordingly, the delay condonation application is allowed. The delay of 39 days in filing the appeal is hereby condoned.
7. Let the lower court record be summoned.
8. List this case on 23.09.2025 on 10.30 A.M. for final hearing.
9. On the said date, both parties shall remain present before this Court to explore the possibility of an amicable settlement. In case any party faces difficulty in appearing before the Court, such party shall in advance inform the other party.
