Mr. Ankuri Raj David, learned counsel for revisionist.

2. Mr. S.C. Dumka, learned A.G.A. with Ms. Sweta Badola Dobhal, learned Brief Holder for the State of Uttarakhand/ respondent No.1.

3. Mr. Bhavya Pratap Singh Rautela, learned counsel for respondent No.2, appeared through video conferencing.

4. This revision is directed against the impugned judgment and order dated 08.09.2022 passed by learned Judicial Magistrate, Rishikesh, District Dehradun, in Criminal Case No.89 of 2017 Lallan Prasad Vs. Amit Kumar, whereby, the revisionist was convicted under Section 138 of the Negotiable Instruments Act, 1881, and sentenced to undergo with three months' simple imprisonment with fine of Rs.1,70,000/- out of which Rs.1,65,000/- was directed to pay respondent No.2, as well as the judgment and order dated 08.01.2024 passed by the learned First Additional Sessions Judge, Rishikesh, District Dehradun, in Criminal Appeal No.242 of 2022 Amit Kumar Vs. State of Uttarakhand and Another, whereby, the said appeal of the revisionist was dismissed by affirming the conviction and sentence of the revisionist vide judgment and order dated 08.09.2022.

5. As per office report, there is 463 days' delay in filing the instant criminal revision. Along with the present criminal revision, a compounding application (IA/1/2025) has also been filed stating therein that the parties have amicably settled the dispute and want to compound the present matter with the permission of this Court.

6. Learned counsel for the respondent No.2 submits that he has no objection if the delay is condoned.

7. Having considered the reasons assigned in the affidavit filed in support of delay condonation application, this Court is of the view that the grounds mentioned are sufficient enough to condone the delay. Accordingly, the delay condonation application (IA/3/2025) is allowed.

8. The delay of 463 days' in filing the instant criminal revision is condoned.

9. Put up on 11.09.2025, for consideration of compounding application (IA/1/2025). On which date, parties shall remain present before this Court.
