Present Second Appeal has been preferred by the appellant against the judgment and order dated 29.04.2022, passed by 7th Additional District Judge, Dheradun, in Civil Appeal No. 146 of 2018, Subhash Chandra Ahuja vs. Satish Chandra Ahuja, whereby the Regular Civil Appeal preferred by the appellant against the judgment and decree dated 26.10.2016, passed by the learned 3rd Additional Civil Judge (S/D), Dehradun in Original Suit No. 511 of 2009, Subhash Chandra Ahuja vs. Satish Ahuja, whereby the suit of the appellant seeking relief for mandatory injunction and declaration of the suit property has been dismissed and counterclaim of the respondent against the appellant in respect to the suit property has been allowed/decreed.
5. Learned counsel for the appellant submits that the matter has been settled between the parties, as such, he does not want to press the Second Appeal. 2025:UHC:7192
6. Accordingly, the Second Appeal is dismissed as withdrawn.
