1. Mr. Harshpal Sekhon, learned counsel for the appellant.

2. Mr. G.S. Sandhu, learned Additional Advocate General for the State.

3. As per the office report the appeal is well within time.

4. Admit.

5. Summon the Trial Court record.

6. The instant criminal appeal has been preferred against the judgment and order dated 26.03.2025 passed by the Special Sessions Judge, Udham Singh Nagar, whereby, the appellant has been convicted for the offence punishable under Section 135(1) of the Electricity Act and sentenced to undergo 3 months simple imprisonment in Special Sessions Trial No. 220 of 2018 'State of Uttarakhand vs. Arvind Kumar Dhawan'.

7. Learned counsel for the appellant submits that while convicting the appellant the appellant was granted interim bail for 30 days by order dated 26.03.2025.

8. Apart from this, he submits that the conviction is bad since the offence as alleged is compoundable.

9. Mr. G.S. Sandhu, learned Additional Advocate General admits this fact that the appellant is on interim bail.

10. After hearing the arguments of learned counsel for the parties and further without expressing any opinion on the merit of the case, the bail application is allowed.

11. Interim bail dated 26.03.2025 passed by the trial court is made absolute. Appellant shall remain on bail, during the pendency of this appeal, on the same personal bond and sureties and on the same terms and conditions, as mentioned by the trial court in the order dated 26.03.2025. Fine imposed by the trial court shall also remain suspended during the pendency of this appeal.
