Mr. Dhruv Chandra, learned counsel for the petitioners/accused.
2. Mr. Deepak Bisht, learned Deputy A.G. for the State.
3. Ms. Garima Thapa, learned counsel for respondent no. 3/complainant.
4. Counsel for the petitioners/accused would submit that the matter has been amicably settled between the parties; that, now respondent no. 3 does not want to prosecute the petitioners, hence, a Compounding Application (IA No.1 of 2025) along with affidavit of the petitioners and respondent no. 3, have been filed before the Court.
5. Learned State counsel would vehemently oppose the compounding application on the ground that the offences alleged against the petitioner/accused are serious in nature and the same are against the society; that, the offences alleged against petitioners/accused have a serious impact upon the society.
He would further submit that Hon'ble Supreme Court in catena of judgments have held that the criminal proceedings in serious cases cannot be quashed on the basis of any financial settlement with the complainant/victim; that, if the criminal proceedings in serious offences are quashed by the Courts on the basis of compromise then the interest of justice will be jeopardy.
6. Learned State counsel seeks and is grated two weeks time to file counter affidavit.
