The Court made the following:
JUDGMENT:

(per Hon'ble The Chief Justice Ms. Ritu Bahri)

Learned counsel for the respondent-writ

petitioner states that as per the application form

(Annexure-5, at Page No.38 to this writ petition),

the petitioner has applied for two posts, and one of

the posts is of Power Transmission Corporation of

Uttarakhand Ltd.

2. Learned counsel for the appellants states

that the Uttarakhand Power Corporation Ltd. is

respondent no.2 in the writ petition, and the Power 2024:UHC:6798-DB Transmission Corporation of Uttarakhand Ltd. has

not been made a party. Hence, the appellants are

not bound to consider the case of the respondent-

writ petitioner, as the respondent- writ petitioner

never applied for any post, which was in the

Uttarakhand Power Corporation Ltd.

3. Learned State Counsel has further

informed that the Committee has been constituted

on 15.11.2017, pursuant to the directions given by

this Court on 26.07.2017.

4. Keeping in view the above fact, order

dated 26.07.2017, passed by the learned Single

Judge in Writ Petition (S/S) No.28 of 2016, is being

modified to the extent that the Committee will

examine the issue of equivalence of qualification of

the respondent- writ petitioner and take a decision,

and since the application has not been made to the

present appellants, the appellants are not bound to

give any appointment.

5. The special appeal is being disposed of in

the above terms.

6. Pending application, if any, also stands

disposed of.
