This is a petition under Section 482 of the Code of Criminal Procedure, 1973, to quash and set aside the entire proceedings as well as the impugned charge-sheet no. 05 of 2014, dated 26.10.2014, submitted by the I.O., P.S. Salt, District Almora, in FIR No. 06 of 2014, by which, the accused-applicant has been summoned to face the trial by the learned Chief Judicial Magistrate, Almora.

2. The petitioner preferred this petition against the said order. During the pendency of this petition no stay order was granted by the Hon'ble High Court. Thereafter, the Trial proceeded before the Trial Court. Today, the parries have filed a copy of the judgment delivered by the learned Sessions Court on 27.07.2015, by which, the accused Ram Singh Rawat has been acquitted of the charges levelled against him. The said copy of the judgement has been obtained online by the counsel for the parties. After acquittal by the Trial Court, there is no case pending against the petitioner at present. In view of that, this

petition has become infructuous and there is no cause to proceed further in this matter.

3. In that view of the matter, the parties have filed a compromise deed. The learned counsel have the power to file the compromise in this matter. Parties have filed their compromise-deed before this Daily Lok Adalat, which reads as under:

"During the pendency of the above noted criminal misc. application, the matter being tried by the Court of Sessions judge was committed to the Court of ld. Sessions Judge, Almora, and the ld. Sessions judge vide judgment and order dated 27.07.2015, passed in ST No. 8 of 2015, State vs. Hansa Singh Negi & others, has acquitted all the accused persons including the present applicant.

Therefore, it is prayed to dismiss the above noted criminal misc. application as infructuous.

Dated 05.06.2024."

4. In view of the above, the trial before the Trial Court has come to an end and there is no grievance of the petitioner against any of the order of the Trial Court and this petition has become infructuous.

5. In view of the above, this petition is disposed of in terms of the compromise-deed filed by the respective counsel for parties and this compromise-deed will form part of this Order.
