The Court made the following:


JUDGMENT:

(per Hon'ble The Chief Justice Ms. Ritu Bahri)

As per the order dated 03.01.2024, passed by the

learned Single Judge, in Writ Petition (M/S) No. 3096 of

2017, it was directed that the Chairman of State Bank of

India, or any other officer nominated by him, not below the

rank of Managing Director, shall take a decision on the

representation of the petitioners (respondent Nos. 1 and 2

herein).

2) Counsel for the appellant Bank states that the

Managing Director is also posted in Mumbai, and in this

backdrop, the procedure will be very tedious, and if a Zonal

Manager stationed at Delhi is appointed, it would be a better

option. On the other hand, counsel for respondent Nos. 1

and 2 states that even a Director of the Bank can decide the

representation of respondent Nos. 1 and 2.

3) Since the Zonal Manager is posted at Delhi, it will

be convenient for both the parties to appear at Delhi.

4) In such view of the matter, the order dated

03.01.2024, passed by learned Single Judge, in Writ Petition

(M/S) No. 3096 of 2917, is being modified with a direction

that the Chairman, State Bank of India can nominate the

Zonal Manager of State Bank of India at Delhi to decide the

representation of respondent Nos. 1 and 2.

5) With the modification as above, the special appeal

stands disposed of.
