In the instant C482 Application, the challenge has been given by the present applicant, who is an accused being tried for the commission of offences under Section 420 of the IPC and Section 51/63 of the Copyright Act, and has given a challenge to the summoning order that has followed.
Since, all these offences carry a sentence of less than seven years, as such, the applicant in his relief clause has prayed, that in the proceedings of Criminal Case No.1564 of 2018, which are pending consideration before the Court of Judicial Magistrate, Roorkee, District Haridwar, he may be permitted to surrender before the said Court with the liberty left open for him to resort to the remedies as provided by the dictum of the Hon'ble Apex Court as laid down in the judgment of Satender Kumar Antil Vs. Central Bureau of Investigation, as reported in 2022 (10) SCC 51.
With the aforesaid liberty left open for the applicant to surrender and seek his bail in the light of the guidelines framed in paragraph no.3(e) of the judgment of Satender Kumar Antil(supra), the C482 Application would stand disposed of.
