3. Counsel for the revisionist would submit that the impugned judgment has been passed without any evidence and ignoring the facts of the case and therefore the same is unsustainable in the eyes of law.
4. Issue notice to respondent no.2 through ordinary process and registered post, acknowledgement due as well as by email and WhatsApp, if available.
5. Steps to be taken within a week.
6. List this matter on 22.11.2023.
7. Having considered the submissions of learned counsel for the revisionist and upon perusal of the grounds mentioned in the memo of revision, it is directed that the effect and operation of the impugned judgment/order dated 09.08.2023 passed by Judge, Family Court, Vikasnagar, District Dehradun in Misc. Criminal Case No.143/2019 "Smt. Seema vs. Laxman Singh Rawat", shall remain stayed subject to the condition that the revisionist shall deposit 50% of the total arrears before the Tribunal as stated in para 2 of the operative part of the impugned judgment/order within a period of one month from today and shall also pay maintenance to the respondent no.2 as stated in para 3 of the operative part of the impugned judgment/order.
8. Stay application stands disposed of.
