(2) Respondent no. 4 has applied for modification of the order dated 11.8.2021 on the ground that Mussoorie Dehradun Development Authority is not proceeding to consider the house plan submitted by him for sanction. The order of refusal passed by the Mussoorie Dehradun Development Authority is enclosed as Annexure no. 2 and 3 to the modification application (MCC/11696/2023) for contending that MDDA is still treating the order of status quo, passed in the present writ petition at the time of admission, to be operating.

(3) This Court is not inclined to modify the order dated 11.8.2021, as the interim order passed by this Court operates only during pendency of the writ petition. After decision in the writ petition, interim order merges in the final order. Since it is settled legal position, therefore, no modification of the final judgment/order is needed. (4) Modification application stands disposed of accordingly.
