Hon'ble Alok Kumar Verma, J.
Heard Mr. D.S. Patni, learned Senior Advocate assisted by Mr. Siddhant Manral, learned counsel for the revisionist and Mrs. Manisha Rana Singh, learned A.G.A. on the Amendment Application. The Amendment Application (IA No. 2 of 2023) is allowed.
2. Mr. D.S. Patni, Senior Advocate, has sought 24 hrs time to file an amended memo of Criminal Revision and Stay Application.
3. Respondent no. 2 had filed an Application under Section 12 of the Protection of Women from Domestic Violence Act, 2005 against her husband- revisionist. The said Application was partially allowed and the revisionist was directed to pay Rs. 10,000/- per month to his wife, respondent no. 2 and Rs. 5,000/- per month to his minor daughter from the date of the Application i.e. 23.11.2012.
4. Revisionist preferred an Appeal (Criminal Appeal No. 29 of 2023) challenging the said judgment dated 31.03.2023.
5. The Appellate Court, vide order dated 19.09.2023, directed the revisionist to deposit 30 % of the awarded amount.
6. Mr. D.S. Patni, learned Senior Advocate, has sought one week's time to deposit 20% of the awarded amount.
7. Issue notice to respondent no. 2.
8. Steps to be taken within 48 hrs.
9. List on 09.11.2023 after fresh cases.
10. Subject to deposit 20 % of the awarded amount, remaining outstanding amount is kept in abeyance till the next date of listing.
