1. Mr. Vijay Bhatt, learned counsel for the appellants.

2. Issue notice.

3. Mr. B.S. Parihar, learned Standing Counsel for the State appears and accepts notice on behalf of respondent Nos. 1 to 3.

4. Issue notice to respondent No. 4, returnable on 06.05.2024, by all permitted modes, including electronically.

5. Mr. Bhatt submits that the impugned judgment is contrary to the view taken by this Court in Pradeep Singh Vs Director General, Assam Rifles UPAO Branch (NE- III), Shillong-I and others, in Special Appeal No. 54 of 2022, decided on 04.04.2022, and the orders passed by this Court in SPA No. 425 of 2021, decided on 30.08.2022, and; SPA No. 428 of 2021, decided on 30.08.2022.

6. In the light of the aforesaid, we stay the operation of the impugned judgment, till the next date.

7. List the matter on 06.05.2024.
