This is a criminal revision filed by the revisionist-

accused, who was convicted vide judgment and order dated

04.08.2018 under Section 138 of Negotiable Instruments

Act, 1881 for a period of one year and a fine of

Rs.5,55,000/- with default stipulation of six months'

additional imprisonment passed by learned trial court, which

was affirmed in the appeal preferred by the accused-

revisionist being Criminal Appeal No.45 of 2018 on

15.02.2020.

2. Today, the matter is taken up in the National Lok

Adalat in the premises of the High Court of Uttarakhand.

Both the parties, revisionist-accused-Imtiyaz Khan and

complainant-Ravindra Aswal are present in-person. The

matter is finally settled in terms of the written agreement

entered into between the parties.

3. Both the parties to the litigation, revisionist-

Imtiyaz Khan and complainant-Ravindra Aswal are identified

by their respective Advocates.

4. According to the compromise, the total amount of

Rs.5,55,000/- has already been paid by the revisionist to the

complainant (respondent no.2-Ravindra Aswal). The

compromise is also signed by both the parties duly identified

by their respective Advocates.

5. The present Criminal Revision is allowed in terms

of the written compromise entered into between the parties.

The said compromise will be part of this order.

6. Accordingly, the judgment and order dated

04.08.2018 passed by learned trial court and judgment and

order dated 15.02.2020, passed by learned appellate court

are set-aside. Revisionist is acquitted of the charge under

Section 138 of the Negotiable Instruments Act, 1881.
