Revisionist-accused Smt. Shama Rao was convicted and sentenced to undergo simple imprisonment for a period of one year along with a fine of Rs.5,00,000/- under Section 138 of the Negotiable Instruments Act, 1881.
2. An Appeal (No.75 of 2017) was filed against the said judgment dated 25.04.2017, passed by learned Judicial Magistrate/Ist Additional Civil Judge (Junior Division), Haridwar. The said Appeal has been dismissed vide judgment dated 04.12.2020, passed by learned IIIrd Additional Sessions Judge, Haridwar.
3. Proposed Criminal Revision has been filed along with an Application under Section 5 of the Limitation Act, 1963 to condone the delay of 460 days'.
4. Heard Mr. P.C. Petshali, learned counsel for revisionist, Mrs. Manisha Rana Singh, learned A.G.A. for State and Mr. Yogesh Upadhyaya, learned counsel for respondent no.2-complainant on the Delay Condonation Application.
5. Delay Condonation Application has not been opposed by the respondent no.2. The Delay Condonation Application is allowed. The delay of 460 days' is condoned.
6. Admit.
7. At the request of both the parties, present Revision is referred to the National Lok Adalat, along with Criminal Revision No.241 of 2021, which is scheduled to be held on 07.10.2023.
