Revisionist has been directed to pay Rs. 6,000/- per month to his wife, respondent no. 2 under Section 125 of the Code of Criminal Procedure, 1973. Against the said judgment dated 02.09.2023, passed by learned Judge, Family Court, Vikas Nagar, District Dehradun in Criminal Miscellaneous Case No. 02 of 2022, present Criminal Revision has been filed.
2. Heard Mrs. Bina Pande and Mrs. Preeta Bhatt, learned counsel for the revisionist and Mrs. Manisha Rana Singh, learned A.G.A. for the State.
3. Supplementary affidavit is taken on record.
4. Mrs. Bina Pande, learned counsel appearing for the proposed revisionist, submits that the income of the revisionist is Rs. 16,000/- per month.
5. In the facts and circumstances of the case, it seems appropriate to grant an opportunity of hearing to the respondent no. 2 even before passing any order on Admission.
6. Learned counsel for the revisionist has requested for dasti.
7. Issue notice to respondent no. 2 by all permissible modes including dasti.
8. Steps to be taken within two days, as prayed.
