The present applicant has put a challenge to the proceedings of Criminal Case No. 5750 of 2021, State Vs. Lakhmir @ Lakhvinder Singh Lakkha and others, wherein, the present applicant has been summoned to be tried for the offences punishable under Sections 323, 324, 506 and 427 of the IPC.
While putting a challenge to the aforesaid proceedings, and the consequential summoning order and the chargesheet, which are the foundation of the criminal case, the applicant has pleaded in para 11 of the C-482 Applicationm that the matter stands covered by the judgment of the Hon'ble Apex Court as reported in (2022) 10 SCC 51, Satender Kumar Antil Vs. Central Bureau of Investigation and another.
The applicant has sought disposal of this C- 482 Application based on the principles of judgment of Satender Kumar Antil (Supra).
In view of the aforesaid admitted case of the applicant, the C-482 Application would stand disposed of, directing the learned Trial Court i.e., the Court of Judicial Magistrate 1st, Rudrapur, District Udham Singh Nagar, to decide the aforesaid criminal case and bail application in the light of judgment of Satender Kumar Antil (Supra), upon the surrender of the applicant before the said Court.
Subject to the aforesaid, the C-482 Application would stand disposed of.
