Present Appeal has been filed under Section 384 of the Indian Succession Act, 1925 against the judgment dated 05.01.2023, passed by learned Senior Civil Judge, Halwani, District Nainital in Succession Application No.11 of 2019, "Smt. Parveen Jahan and Others vs. Smt. Rani Begum and Others", by which, the succession application has been allowed.

2. Heard Mr. Dharmendra Barthwal, learned counsel for the appellant and Mr. Rajesh Sharma, learned counsel for the respondent no.4.

3. Mr. Dharmendra Barthwal, Advocate, for the appellant submitted that the deceased Abdul Salam had two wives, two daughters and four sons. Smt. Parveen Jahan is second wife and appellant is the first wife of the deceased. Sons of the deceased were not impleaded in the said case.

4. Admit.

5. Issue notice to the respondent no.1. Steps to be taken within a week.
