An Application to set aside the ex- parte judgment and decree, passed in SCC Suit No. 15 of 2017, has been filed by the revisionist - defendant. In the said Miscellaneous Case, an Application was moved by the revisionist saying that he is ready to give security of the amount due from him under the ex-parte decree. Learned Trial Court, while passing the order dated 01.10.2022, granted permission to the revisionist - defendant to deposit the decretal amount. A Review Application to review the said order dated 01.10.2022 was filed by the revisionist. The said Review Application has been dismissed by impugned order dated 19.01.2023.
Heard Mr. Siddhartha Singh and Mr. P.S. Bisht, learned counsel for the revisionist.
Mr. Siddhartha Singh, Advocate, submitted that the revisionist - defendant is ready to give security of the amount due from him under the ex-parte decree.
Issue notice to the respondent through normal mode as well as by dasti.
