                            JUDGMENT

Hon'ble Ravindra Maithani, J. (Oral)

The revisionists have been convicted in

Complaint Case No.1735 of 2007, Deputy Forest

Conservator Vs. Suresh and Others, by the court of

Chief Judicial Magistrate, Dehradun for the offences

punishable under Section 51 of the Wild Life (Protection)

Act, 1972. The conviction was subsequently upheld in

appeal on 29.11.2022. It is also impugned.

2. Heard learned counsel for the parties and

perused the record.

3. It is argued by learned counsel for the

revisionists that, in fact, three co-convicts have already

filed revision, which has been admitted and they have

been released on bail.

4. This fact is admitted to learned State

Counsel.

5. Admit.

6. List this matter on 09.05.2023 along with

CRLR No.83 of 2023.

7. Heard on bail application (IA No.3 of 2023).

8. On the similar grounds, the co-convicts

have already been enlarged on bail. Without adverting

much to the merits, in view of it, this Court is of the view

that the execution of the sentence appealed against may

be suspended during the hearing of the revision.

9. The bail application is allowed.

10. The execution of impugned sentence shall

remain in abeyance during the pendency of the revision.

11. Let the revisionists be released on bail, on

their executing a personal bond and furnishing two

reliable sureties, each of the like amount, by each one of

them to the satisfaction of the court concerned.
