Revisionist was convicted under Section 138 of

the Negotiable Instruments Act, 1881 and was sentenced to

undergo rigorous imprisonment for a period of six months

along with a fine of Rs.40,000/- The Appeal (Criminal

Appeal No.34 of 2022), filed against the said judgment

dated 06.06.2022, passed by learned Trial Court, has been

dismissed vide judgment dated 02.11.2023, passed by

learned Sessions Judge, Pithoragarh.

2. Supplementary affidavit is taken on record.

3. Heard Mr. Amit Kapri, learned counsel for the

revisionist and Mr. M.K. Chand, learned AGA for the State.

4. Mr. Amit Kapri, Advocate, submits that the

revisionist is ready to deposit the entire amount before the

Court concerned within two months from the date of his

release on bail.

5. Admit.

6. Issue notice to the respondent no.2. Steps to be

taken within a week.

7. List on 26.02.2024.

8. Heard on the Bail Application (IA No.01 of 2023).

9. Mr. Amit Kapri, Advocate, submits that the

revisionist was on bail during the trial and the appeal, and,

the conditions of bail were never misused by him.

10. Having considered the submissions of learned

counsel for the revisionist and in the facts and

circumstances of the case, this Court is of the view that the

revisionist deserves bail at this stage.

11. The Bail Application (IA No.01 of 2023) is allowed.

12. Let the revisionist - Narayan Ram be released on

bail on his executing a personal bond and furnishing two

reliable sureties, in the like amount, to the satisfaction of

the Court concerned.
