Hon'ble Alok Kumar Verma, J.

Revisionist - accused Ganesh Dutt Bhatt was

convicted and sentenced to undergo simple imprisonment

for a period six months along with a fine of Rs.3,30,000/-

under Section 138 of the Negotiable Instruments Act, 1881.

Against the said judgment, an Appeal was filed by the

revisionist. The said Appeal (Criminal Appeal No.10 of 2017)

has been dismissed vide judgment dated 14.09.2023,

passed by learned Sessions Judge, District Pithoragarh.

2. Today, before the National Lok Adalat, the

revisionist - accused Ganesh Dutt Bhatt is present in-

person. He is identified by Mr. Amit Kapri, Advocate.

3. Mr. Mahendra Singh Rawat, Advocate, with the

respondent no.2 - complainant is present.

4. Both the parties have filed a Compromise

Application. It has been submitted by respondent no.2 that

since the revisionist has already deposited the disputed

amount, hence, the respondent no.2 does not want to

proceed with the present matter.

5. The Compromise Application is verified.

6. The Criminal Revision deserves to be allowed and

is accordingly allowed by holding that since the offence has

been compounded, the revisionist is entitled to acquittal.

7. The judgment dated 14.09.2023, passed by

learned Appellate Court and the judgment dated

17.10.2016, passed by learned Trial Court are set aside. The

revisionist is ordered to be acquitted of the charge levelled

against him.
