In this C482 application, the heirs of the complainant have filed an application, to bring them on record in order to enable them to contest the complaint proceedings under section 138 of the Negotiable Instruments Act.
While the learned counsel for the heirs of the complainant is pressing the application, it has been informed by the learned counsel for the applicant that the judgment of the conviction has already been rendered in Criminal Complaint Case No.4152 of 2023, on 13.01.2023, against which the Criminal Appeal No.16 of 2023, "Bharat Singh Chauhan Vs. State of Uttarakhand", is pending consideration before the court of District and Sessions Judge.
In view of the aforesaid subsequent development, no orders are required, as such, to be passed on the application which has been filed by the respondent. But closing this C482 application on the aforesaid ground will not preclude the present respondent, to file an appropriate application in the pending appeal to bring themselves, on record, and to contest the proceedings.
