2. Present appeal has been preferred against the impugn judgment and award dated 06.07.2019 passed by M.A.C.T./4th Additional District Judge, Dehradun in M.A.C.P. No. 78 of 2016, whereby compensation of `10,54,390/- along with interest @9% per annum has been awarded and the liability of 50% of the total awarded amount is fixed upon the appellant to pay the claimant.
3. Counsel for the appellant would submit that the tribunal without considering the evidence on record has passed the impugned and has wrongly imposed the liability of 50% amount upon the appellant.
4. Admit the appeal.
5. In view of the above, it is directed that the execution of the impugned judgment and award dated 06.07.2019 passed by M.A.C.T./ IVth Additional District Judge, Dehradun in M.A.C.P. No. 78 of 2016 shall remain stayed subject to deposit of entire share amount as directed by the Tribunal within a period of one month from today adjusting the statutory deposit made by the appellant.
6. Stay application (CLMA 12787 of 2019) stands disposed of accordingly.
7. List this case on 21.11.2023.
