The proposed Second Appeal has been filed against the judgment and decree dated 18.12.2021, passed by the learned IVth Additional District Judge, Haridwar in Civil Appeal No.53 of 2020, "Master Divyansh, minor and Master Aashu alias Ayush, minor, through natural guardian vs. Vijay Kumar", by which, the said civil appeal, filed against the judgment and decree dated 27.01.2020, passed by the learned Trial Court in Original Suit No.169 of 2012, has been dismissed. The said Original Suit was dismissed.

An application under Section 5 of the Limitation Act, 1963 has been filed along with the proposed Second Appeal to condone the delay of 77 days' in filing the Second Appeal.

Heard Mr. Abhijay Negi, learned counsel for the applicants.

Mr. Abhijay Negi, Advocate, requested for dasti notice.

Issue notice to the respondent on the delay condonation application by usual mode as well as by dasti.
