The present C482 Application arises out of the Criminal Case No. 832 of 2022, State Vs. Mukesh Singh Mehar, which is arising out of NCR No. 3 of 2022, whereby, the applicant is being tried for the offences under Sections 171-B and 171-E of the IPC, which was registered against him at Police Station Tanakpur, District Champawat.

The challenge in the C482 Application has been given by the applicant to the chargesheet dated 4th June, 2022 and as well the summoning order dated 25th August, 2022.

There are various facets, which has been argued by the learned counsel for the applicant to oust himself from the implications of Section 171-B and 171-E of the IPC.

But, after arguing for length, the learned counsel for the applicant has ultimately confined his relief to the effect, that an appropriate direction may be issued to the Judicial Magistrate (1st Class), Tanakpur, District Champawat, to expedite the proceedings of Criminal Case No. 832 of 2022, State Vs. Mukesh Singh Mehar.

Owing to the aforesaid argument, this C482 Application is being disposed of without venturing into the merits of the matter, with the request to the Court of In-charge, Judicial Magistrate, Tanakpur, District Champawat, to make an effort to decide the aforesaid Criminal Case No. 832 of 2022, State Vs. Mukesh Singh Mehar, as expeditiously as possible, but not later than six months from the date of production of certified copy of this judgment.
