                                  Hon'ble Sharad Kumar Sharma, J.

Dr. Udyog Shukla, Advocate, for the petitioner Mr. Devesh Ghildiyal, Brief Holder, for the State of Uttarakhand.

Mr. V.K. Kaparuwan, Advocate, for respondent No. 2.

The petitioner in the present Writ Petition has come up with the case, that he has been registered with the Mining Department, for carrying out the mining activities, bearing Registration No. NK I- 0259, under which, he carries out the mining activities in Nandhur River.

For undertaking the mining activities, the petitioner had initially got the vehicle registered, bearing Registration No. HR-38-H-7300, which as per the policy enforced by the State, i.e. on the basis of the decision taken by the Committee on 20th November, 2014 and 25th February, 2015, the old vehicles were to be replaced.

The petitioner had offered for registration of the vehicle bearing No. UK-04CB 4152, which is not being registered by the respondents, in order to enable him to undertake the mining activities under the registration which already stands granted in his favour.

Learned counsel for the petitioner submits that same issue was dealt with by this Court in Writ Petition (M/S) No. 2157 of 2021, Gokulanand Neoliya Vs. State of Uttarakhand and others, as decided on 8th October, 2021, and hence, the matter would stand covered by the said judgment, which is a fact not disputed by the respondents' Counsel.

Hence, this Writ Petition too would stand disposed of under the same terms and conditions as that of the judgment dated 8th October, 2021, rendered in Writ Petition (M/S) No. 2157 of 2021.

The Writ Petition is disposed of accordingly.

(Sharad Kumar Sharma, J.) Dated 07.05.2022 Shiv
