Mr. Pradeep Hairiya, Standing Counsel, for the State of Uttarakhand.

The petitioner contends that he is the owner of the Vikram Three Wheeler bearing Chasis No.MCYL5S447600914 and Engine No.S8E8854000, and he contends that he was an applicant for registration of the said vehicle, and had moved an appropriate application before the ARTO, to get the said vehicle registered, but the same could not be done on account of the fact that the vehicle was seized, and was later on it was got released by the Competent Authority under Section 207 of the Motor Vehicle Act.

The release order has been placed by the petitioner on the record of the writ petition, by way of filing of a supplementary affidavit, and the petitioner has pleaded that the conditions of the release of depositing the penalty amount has already been complied with.

In view of the aforesaid, since the petitioner's vehicle has already been released, and he has deposited the penalty amount, as imposed under sub-section (2) of Section 207 of the Motor Vehicle Act, this writ petition is being disposed of with the direction to the respondent No.2, to consider the petitioner's application for registration of his vehicle as per law, within a period of two months from the date of the production of a certified copy of this judgment, and it goes without saying that the registration of the vehicle would be considered, as per law.

Subject to the aforesaid, the writ petition stands disposed of.
