Upon hearing the learned Counsel, the Court made the following
JUDGMENT :(per Sri S.K. Mishra, A.C.J.)
None appears for the petitioners.
2. Interim protection was granted to the petitioner on
18.05.2021, by this Court.
3. Mr. J.S. Virk, the learned Deputy Advocate General
appearing for the State, submits that he has no instructions
in the matter.
4. Since almost ten months have elapsed, in the
meantime, threat perception might have changed. So, we
dispose of the writ petition with a direction to the Senior
Superintendent of Police, Nainital to take a decision within a
period of twenty one days from the date of receipt of a
certified copy of this order, whether to continue to give
protection to the petitioners, or not?
5. In case, the petitioners face any further problem
and the cause of action persists in the shape of threat to their
lives and property, they are at liberty to file an application for
modification/recall of this order.
6. Urgent certified copy of this order be issued to the
parties on proper application.
