Upon hearing the learned Counsel, the Court made the following
JUDGMENT : (per Sri Vipin Sanghi, C.J.)
The matter is listed before this Court in the light
of the order dated 15.01.2020 passed by the Hon'ble
Supreme Court in Civil Appeal No. 1414 of 2007 (Civil
Appeal No. 999 of 2007 being the leading case), whereby
the Hon'ble Supreme Court remanded, inter alia, the
present petition to this Court for proper adjudication in
accordance with law while leaving all questions open. The
writ petition had earlier been disposed of on 19.12.2006.
2. Mr. P.R. Mullick, the learned counsel for the
petitioners, has very fairly pointed out that the present case
is squarely covered by the judgment of this Court in Writ
Petition (M/S) No. 1073 of 2022, decided on 19.05.2022, in
relation to a sister concern of the present petitioners.
3. By the said judgment, this Court dismissed the
petition, wherein the same issues had been raised by the
petitioners' sister concern. We follow the said judgment
and, accordingly, dismiss the present petition.
